The man 23-year-old man identified as MacDonald Kusala was arrested after his younger brother walked in on him raping their mother and called the police in Malawi.
Kusala was immediately detained and prosecuted where he told the court that he was drunk when he committed the incestuous act. He pleaded with the court for forgiveness.
The court heard how a drunk Kusala went to visit his mother, saw her sleeping, undressed her and then had sex with her.
The prosecutor prayed the court to impose the death penalty but the judge sentenced Kusala to 7 years in prison.
Police confirmed Kusala was high on large amounts of alcohol before committing the crime.
